Welcome to the websites, services and online offerings operated by Kerri Jarrett, including kerrijarrett.com, kerri-jarrett.com and thehaircoach.ca (collectively, the “Websites”).

These Terms & Conditions (“Terms”) govern your use of the Websites and the products and services offered through them, which may include:

- Trichology assessments and consultations

- Hair and scalp services

- Hair coaching and follow-up services

- Cosmetology services

- Epigenetic or lifestyle-related educational services

- Business consulting, coaching or mentorship

- Courses, memberships and educational programs

- Digital products and resources

- Workshops and events

- Jewelry, artwork and other physical products

- Email communications and other online content

By accessing or using the Websites, purchasing a product or service, creating an account, booking an appointment or participating in one of our programs, you agree to these Terms and any additional terms or policies presented at the time of purchase or booking.

If you do not agree with these Terms, please do not use the Websites or purchase the applicable services.

2. Eligibility and Use of the Websites

By using the Websites, you agree that you:

- Are legally capable of entering into an agreement or have appropriate parental or guardian authorization

- Will provide accurate information when making purchases, bookings or registrations

- Will not use the Websites for unlawful or fraudulent purposes

- Will not attempt to gain unauthorized access to our Websites, accounts, systems or data

- Will not intentionally interfere with Website operation or security

- Will not copy, scrape, reproduce, distribute or commercially exploit Website content without authorization

- Will comply with applicable laws and these Terms

- We may restrict or terminate access where we reasonably believe these Terms have been violated.

3. Intellectual Property

Unless otherwise stated, content made available through the Websites or our services is owned by or licensed to Kerri Jarrett and is protected by applicable intellectual-property laws.

- Frameworks and methodologies

- Assessments and questionnaires

- Worksheets and workbooks

- PDFs and downloads

- Graphics and illustrations

- Photography

- Videos and recordings

- Presentations

- Logos and branding

- Product designs

- Educational systems, models and training materials

Purchasing a product, program, course, membership or service does not transfer ownership of the underlying intellectual property.

Unless expressly authorized in writing, materials are provided for your personal or authorized professional use only.

You may not reproduce, publish, distribute, upload, sell, sublicense, modify, create unauthorized derivative materials from, teach from, commercially exploit or otherwise redistribute protected materials.

You may not share account credentials, course access, paid downloads, membership content or educational resources with individuals who have not purchased or been granted access.

Nothing in these Terms grants you ownership of any trademark, trade name, course, framework, methodology, design or other intellectual property belonging to Kerri Jarrett or an affiliated business.

4. Professional Education and Educational Materials

Educational content provided through courses, memberships, workshops, articles, mentorship or other resources is provided for educational and informational purposes.

Professional education does not automatically:

- Grant a professional licence

- Expand an individual's legal scope of practice

- Authorize diagnosis or treatment outside that individual's professional scope

- Replace licensing, regulatory or professional requirements applicable in the participant's jurisdiction

Students and professionals are responsible for understanding and practising within their own legal and professional scope.

Certificates of completion, where offered, confirm completion of the applicable educational requirements and should not be represented as a professional licence unless specifically recognized as such by the applicable regulatory authority.

5. Trichology, Hair and Scalp Services

Educational and Professional Scope

Trichology services are intended to help assess and better understand hair and scalp concerns, patterns and contributing factors.

Services may include observation, trichoscopy, hair and scalp assessment, history review, education, hair-care recommendations, cosmetic strategies, lifestyle considerations and referrals where appropriate.

Trichology services do not constitute medical diagnosis, medical treatment or emergency healthcare.

Kerri Jarrett does not diagnose diseases, prescribe medication or replace the care of a physician, dermatologist or other regulated healthcare professional unless a particular service is being provided within another separately authorized professional scope.

Where findings or information suggest that medical evaluation may be appropriate, clients may be encouraged to consult an appropriate regulated healthcare professional.

No Guaranteed Outcome

Hair loss, scalp conditions, hair growth and hair-fibre concerns can be influenced by many interconnected factors.

No specific outcome, diagnosis, rate of hair growth, improvement, recovery or response to a product, treatment or recommendation can be guaranteed.

Recommendations are based on information available at the time of assessment and may change as additional information becomes available or circumstances change.

6. Client Responsibility

The quality and usefulness of an assessment depends in part on the accuracy and completeness of the information provided.

Clients are responsible for:

- Providing accurate and relevant information

- Informing us of significant changes that may affect recommendations

- Following instructions associated with services or products

- Seeking medical care when advised or when symptoms require medical attention

- Informing us of known allergies, sensitivities or contraindications where relevant

- Asking questions where recommendations or instructions are unclear

Clients remain responsible for decisions concerning their own health, hair care and services.

7. Appointments, Assessments and Consultations

Booking policies may vary by service. The policies displayed on the booking or checkout page at the time of booking form part of these Terms.

Consultation and Assessment Fees

Some appointments may require payment in full or a deposit at the time of booking.

Certain consultation or booking fees may be non-refundable, including fees associated with reserving professional time, reviewing intake information, preparing for an appointment or conducting preliminary case review.

Any non-refundable fee will be identified before purchase or booking.

Cancellation and Rescheduling

Unless otherwise stated in the applicable booking policy, appointments should be cancelled or rescheduled at least 48 hours in advance.

Late cancellations, missed appointments and no-shows may result in the loss of the booking fee, deposit or appointment payment.

Repeated cancellations or no-shows may result in future booking restrictions.

Late Arrivals

Late arrival may reduce the available appointment time. Depending on the circumstances, an appointment may need to be rescheduled and applicable cancellation or rebooking fees may apply.

Virtual Appointments

Clients are responsible for ensuring that they have an appropriate device, Internet connection and environment for virtual appointments.

The usefulness of a virtual hair or scalp assessment may be limited by lighting, image quality, camera quality and the inability to perform certain forms of in-person examination.

An in-person assessment or referral may therefore be recommended where appropriate.

8. Products, Recommendations and Third-Party Services

Products, devices, supplements, hair-care products, testing services or other third-party services may occasionally be discussed or recommended.

Recommendations are based on information reasonably available at the time and do not guarantee that a product or service will be appropriate for every individual.

Clients should review ingredients, instructions, contraindications and manufacturer information before using a product.

Where a product or service requires medical oversight, clients should consult the appropriate regulated healthcare professional.

We are not responsible for changes made by third-party manufacturers, providers or suppliers after a recommendation is made.

9. Digital Products, Courses and Memberships

Digital products may include courses, memberships, videos, PDFs, templates, worksheets, recorded education and other downloadable or online resources.

Unless otherwise stated at checkout:

- Purchases provide a limited, personal, non-transferable licence to access the purchased material

- Access may be permanent or time-limited depending on the offering

- Account credentials may not be shared

- Materials may not be copied, redistributed, resold or uploaded to another platform

- Membership access ends when the applicable membership or subscription ends

- Subscription services may renew according to the terms presented at checkout

Because digital products may be immediately accessible, purchases may be non-refundable once access or delivery has occurred, subject to applicable consumer-protection law and any refund terms presented at checkout.

Specific course, membership or program terms presented at the time of purchase take precedence where they differ from these general Terms.

10. Coaching, Consulting and Mentorship

Business consulting, mentorship, coaching and personal-development services are educational and advisory in nature.

No particular financial, business, career or personal result is guaranteed.

Results depend on numerous factors outside our control, including the client's decisions, actions, resources, skills, market conditions and implementation.

Nothing provided through business coaching or consulting constitutes legal, accounting, investment or tax advice.

Where professional advice in these areas is required, you should consult an appropriately qualified professional.

11. Physical Products, Jewelry and Artwork

Physical products may include jewelry, artwork, kits or other goods.

Processing and shipping times are estimates and may vary depending on product availability, customization, destination and other circumstances.

Handmade and Natural Materials

Handmade products and products incorporating natural materials may contain reasonable variations in colour, texture, size, pattern or appearance.

These variations are part of the nature of handmade or naturally sourced materials and are not necessarily considered defects.

Custom and Personalized Items

Custom, commissioned, altered or personalized items may be non-returnable and non-refundable once work has commenced, except where required by applicable law or where an item is defective.

Specific custom-order terms may be provided before production begins.

Damaged or Incorrect Orders

If an item arrives damaged, defective or incorrect, please contact us promptly after delivery and provide photographs or other information reasonably necessary to assess the issue.

Available remedies will depend on the circumstances and applicable consumer-protection requirements.

Shipping

Customers are responsible for providing an accurate shipping address.

International customers may be responsible for applicable customs duties, taxes, brokerage charges or import fees.

We are not responsible for delays caused by carriers, customs authorities, weather or circumstances outside our reasonable control.

12. Pricing and Payments

Prices are displayed in the currency identified at checkout.

Applicable taxes, shipping charges or other fees may be added where required.

Payments may be processed by third-party payment providers.

We generally do not directly store complete credit-card or banking information.

We reserve the right to correct obvious pricing, description or technical errors. If an error affects an order already placed, we

will contact the purchaser where reasonably necessary before proceeding.

13. Refunds

Refund eligibility depends on the type of product or service purchased and the refund or cancellation terms disclosed at booking or checkout.

Generally:

- Digital products may be non-refundable once delivered or accessed

- Appointment deposits or consultation fees identified as non-refundable remain non-refundable

- Late cancellations and missed appointments may not qualify for refund or credit

- Custom or personalized products may be final sale once production begins

- Membership or subscription payments already processed may be non-refundable unless otherwise stated

- Defective, damaged or incorrectly supplied physical products will be addressed in accordance with the applicable purchase terms and consumer law

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable consumer-protection legislation.

14. Testimonials, Reviews and Client Content

We appreciate testimonials, reviews and feedback.

Providing feedback directly to us does not automatically authorize us to publicly disclose sensitive, private, health-related or identifying information.

Where a testimonial, photograph, case study, before-and-after image or other identifiable client material is intended for marketing, educational or promotional use, appropriate permission or consent will be obtained where required.

If you voluntarily publish a public review on a third-party platform, that review is also subject to the terms and privacy practices of that platform.

15. Affiliate Relationships and Recommendations

Some links, products or services mentioned on our Websites may be affiliate or referral links.

We may receive a commission, referral fee or other benefit if you make a purchase through certain links.

Where required, affiliate relationships will be disclosed.

Affiliate compensation does not increase the price you pay unless expressly stated otherwise.

Recommendations reflect our assessment of the product or service at the time they are made; however, clients remain responsible for determining whether a particular product or service is appropriate for their circumstances.

Although reasonable efforts are made to provide useful and accurate information, information may become outdated or may not apply to every individual's circumstances.

Certain services, particularly trichology assessments and consultations, may involve the collection of personal or sensitive information.

We do not control these third parties and are not responsible for their content, availability, privacy practices, security or terms.

We reserve the right, where reasonably appropriate and permitted by law, to refuse, suspend or terminate access to a service, program, membership or Website account.

Reasons may include:

- Fraudulent activity

- Harassment, threats or abusive conduct

- Non-payment

- Repeated violation of appointment policies

- Unauthorized sharing or distribution of protected materials

- Security threats

- Misrepresentation of credentials or educational completion

- Material violation of these Terms

Where appropriate, outstanding contractual, payment, confidentiality or intellectual-property obligations may continue after termination.

21. Governing Law

These Terms are governed by the applicable laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute relating to these Terms or the applicable Websites or services will be addressed in accordance with applicable law.

Where practical, the parties are encouraged to first attempt to resolve disputes through good-faith communication before commencing formal proceedings.

Nothing in this section limits rights or remedies that cannot legally be waived.

We may update these Terms periodically to reflect changes to our services, business practices, Websites or legal requirements.

The current version will be posted on the applicable Website with the Last Updated date shown above.

Changes will apply prospectively from the applicable effective or updated date unless otherwise required by law.

Your continued use of the Websites after updated Terms take effect constitutes acceptance of the updated Terms where permitted by law.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Terms, together with the Privacy Policy and any specific booking, purchase, program, membership, consent or service terms presented to you, form the agreement governing your use of the applicable Websites, products and services.

Where specific terms are provided for a particular product, program or service, those specific terms will apply to that offering.
